Terms of Service

These Terms of Service ("Terms") govern your use of the Trackster CS mobile application and related services (together, the "Service"), operated by an independent individual developer (the "developer", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use Trackster. By using the Service you confirm that you meet this requirement and that the information you provide is accurate.

2. Your account

You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. Notify us promptly of any unauthorized use. You may delete your account at any time from Profile → Settings → Delete Account.

3. Use of the Service and outdoor safety

Trackster records GPS activity and displays maps and routes. Maps, routes, and location data may be inaccurate or incomplete. You are solely responsible for your own safety during any outdoor activity. Always use your own judgment, check conditions, and do not rely on the Service for navigation or in emergencies. The Service is provided for recreational use only.

4. Your content

You retain ownership of the content you create — including tracks, photos, descriptions, comments, and messages ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content solely to operate and provide the Service to you and the audience you choose. You are responsible for your User Content and confirm you have the rights to share it.

6. Moderation, reporting, and enforcement

We do not tolerate objectionable content or abusive behavior. Users can report content and block other users within the app. We may review reports, remove content, and suspend or terminate accounts that violate these Terms or the Community Guidelines, with or without notice.

7. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ends; provisions that by their nature should survive (such as content licenses already granted to other users, disclaimers, and limitations of liability) will survive.

8. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that location data will be accurate.

9. Limitation of liability

To the maximum extent permitted by law, the developer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of (or inability to use) the Service, including personal injury or loss arising during outdoor activities.

10. Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated" date above and, where appropriate, notify you in the app. Continued use of the Service after changes means you accept the revised Terms.

11. Governing law

These Terms are governed by the laws of the country in which the developer resides, without regard to conflict-of-law principles, except where mandatory consumer-protection laws of your country of residence apply.
